Internet crimes include property crimes like credit card fraud, identity theft, ransomeware extortion, account hacking and intellectual property theft. The sentences for property crimes are commonly determined by the amount of monetary loss suffered by the victims. The sentences for crimes facilitated by the internet like drug trafficking, money laundering and the sexual exploitation of minors are generally much longer than those imposed for property crimes. The most draconian sentences being imposed for internet crimes are reserved for those defendants convicted of possessing, producing or distributing child pornography. Prosecutions involving Child Sexual Abuse Material ("CSAM") are complex because they involve a number of unsettled legal issues. Did an internet provider obtain an image said to be CSAM by violating the privacy rights of a subscriber? Did law enforcement obtain suspected CS.AM as the result of an illegal search and seizure? Can expert testimony prove whether the person depicted in an image is a minor? There is a split of authority between state and federal courts on these issues. Any lawyer representing a client charged with an internet crime involving CS.AM must be prepared to address those issues.
